The EB-5, formally called the Employment-Based Fifth Preference immigrant investor visa, became law in 1990 but underwent major changes in 2022. The EB-5 Reform and Integrity Act changed the investment tiers, revised the job creation requirements, and altered how the government allocates visas across the program.

Person Holding US Green Card and Passport in SuitcaseA green card in this category now depends directly on the capital an entrepreneur places at risk, and on the jobs that capital creates. A job offer from a U.S. employer is not part of the requirement, unlike most employment-based visas. Instead, an entrepreneur qualifies through capital investment that leads toward a green card.

The benefits of an EB-5 Investor Visa include that no employee sponsorship is required, spouses and qualifying children are included in the same petition, and that investors can take an active role in the enterprise.

Learn how the investment structure works, what the EB-5 program offers an investor’s family, and how conditional residence becomes a permanent green card.

A Green Card Path Built on the Investor’s Own Capital

No Employer Sponsorship or Job Offer Required

Many employment-based green card cases rely on the same basic mechanism. A company extends a job offer and carries the case through labor certification.

The EB-5 category does not follow that model. An investor’s case rests on the capital placed at risk and the jobs that money produces, not on any employer’s willingness to file on the investor’s behalf. Because of this, the case skips the Program Electronic Review Management labor certification step, one of the longer stages in most employment-based filings.

Two Investment Thresholds Depending on Location

Outside a targeted employment area, the baseline EB-5 investment amount is $1,050,000. This figure applies to cases filed on or after March 15, 2022, the date U.S. Citizenship and Immigration Services (USCIS) last revised the investment amounts.

Investment in a targeted employment area brings that number down to $800,000. USCIS defines this area as either a rural location or one where unemployment reaches 150% of the national rate or higher. Infrastructure projects may also qualify for this same reduced figure.

A Passive Investment Option Through Regional Centers

Running a business alone is not a requirement for EB-5 eligibility. USCIS-designated regional centers pool capital from multiple investors and direct it into projects that already have development and job creation plans in place. An investor who goes through a regional center can count indirect and induced jobs toward the 10-job requirement, not just positions created directly inside the enterprise, which opens a more passive route into the same visa category.

Reserved Visas Improve Availability for Certain Investments

Visa allocation under EB-5 is not one pool. The EB-5 Reform and Integrity Act carved out reserved categories by investment type, with rural projects receiving the largest share at 20%, high-unemployment area projects receiving 10%, and infrastructure projects receiving 2%. Cases in these reserved categories generally see different visa availability than cases outside them, and applicants born in countries with high EB-5 demand often face longer waiting periods in the unreserved category.

Family Immigration Benefits Included in a Single Petition

A Spouse Qualifies for Derivative Status

A second immigrant petition is not necessary for the investor’s spouse. The EB-5 petition covers this individual, and once USCIS approves the underlying petition, the spouse applies for conditional permanent residence on the same filing and the same timeline as the investor.

Unmarried Children Under 21 Qualify Too

This spares a family with several children from filing a separate immigrant petition for each one, though every child must still meet the age and marital status rule at the correct point in the process.

A pending case creates one risk worth watching. A child can age out of eligibility before the case resolves, so an attorney should confirm the filing date and any Child Status Protection Act protections before the petition is filed.

Family Members Gain Work and Study Authorization

A spouse and children who obtain conditional permanent residence through the same petition can generally take a job with any U.S. employer and enroll in U.S. schools, without applying for a separate visa category. Many nonimmigrant family visa categories work differently, where a spouse’s work authorization needs its own application and, in some cases, depends on the primary applicant’s underlying status.

Freedom to Build and Run the Business

Investors Can Take an Active Role in the Enterprise

Federal regulation requires an EB-5 investor to stay engaged in the new commercial enterprise. An investor meets this standard either by handling daily operations directly or by holding a formal decision-making role, such as serving as a corporate officer, sitting on the board, or holding a limited partner position with input on company decisions. An entrepreneur who prefers that level of personal involvement can structure the investment to meet this requirement.

The Investment Can Support a New or Restructured Business

A qualifying investment usually funds a new commercial enterprise, meaning a business formed after November 29, 1990, the date set in the original statute. USCIS also permits an investor to fund the restructuring or reorganization of an existing business, or an existing troubled business, provided the required jobs stay in place. This gives an entrepreneur more than one way to structure a qualifying investment around a business that already exists.

A Defined Path Toward Permanent Residence and Citizenship

Conditional Residence Converts to a Permanent Green Card

An approved EB-5 case leads first to conditional permanent residence, not immediate unconditional status. This conditional period lasts two years.

Within the 90 days before it ends, the investor generally submits Form I-829 to remove the conditions. The filing must show that the investment stayed at risk and that the required jobs were created or preserved. USCIS then confirms whether the requirements were met, and if so, the investor and qualifying family members become permanent residents without the two-year limit.

Eligibility for Naturalization Follows the Standard Timeline

Five years of continuous residence is the standard naturalization timeline, and an EB-5 green card holder follows this same timeline as most other permanent resident categories. Meeting the physical presence threshold and demonstrating good moral character throughout that period are also required. Time spent in conditional status counts toward this timeline. As a result, the investment that started the case also counts toward the residency needed to naturalize.
